- Possession: This is the simplest drug charge to defend, much simpler to defend against than DWI, because in drug charges, there is no breath or blood test that can definitively establish intoxication at the time of the arrest. The district attorney (DA) needs evidence of actual possession.
- Possession with intent: Once possession is established, the DA can charge you with possession with intent to deliver. This charge does not require any separate physical evidence to establish actual intent to distribute; as long as the drug found is of sufficient weight, intent to distribute and be implied.
- Trafficking: Drug trafficking involves the distribution of a larger quantity of a drug. The penalties for trafficking are generally severe.
